Terms of Service

1. The service

FirstCall Permits compiles publicly available building permit records and matches them to the trades and service areas you choose, then delivers them to you as a web feed, email digests and exports (“Leads”). We also provide tools to track your own follow-up on those Leads.

2. Who can use it

The service is for businesses. You must be at least 18 and able to form a binding contract, and you agree you are using FirstCall Permits on behalf of a business, not for personal, family or household purposes. If you sign up for a company, you confirm you're authorized to bind it to these Terms.

3. Your account

• Give us accurate information and keep your login credentials secure.
• Each subscription is for one business. Don't share your login outside your business.
• You're responsible for activity under your account. Tell us promptly at [email protected] if you think it has been compromised.

4. Subscriptions, trials and billing

• Plans are billed in advance at $199/month or $1,999/year, plus any applicable taxes, unless a different price was shown to you at checkout. Payments are processed by Stripe.
• Free trial. New subscriptions include a 14-day free trial. Unless you cancel before the trial ends, your payment method will be charged the plan price when the trial ends.
• Automatic renewal. Your subscription renews automatically at the end of each monthly or annual term, at the then-current price, until you cancel. We'll notify you in advance of any price change, and it applies from your next term.
• Cancelling. You can cancel anytime from Settings → Manage billing. Cancellation takes effect at the end of the current paid term, and you keep access until then.
• Refunds. Except where required by law, payments are non-refundable and we don't give partial refunds or credits for unused time.
• Failed payments. If a payment fails we'll retry it for a limited period. Access may be suspended if payment is not received.
• Promotional or founder pricing applies only on the terms stated when it was offered.

5. How you may use Leads

Leads are licensed to you, not sold. While your subscription is active, you may use Leads to market your own business's products and services. You may not:

• resell, sublicense, publish or share Leads with anyone outside your business;
• use Leads to make decisions about anyone's eligibility for credit, insurance, employment, housing or any other purpose covered by the Fair Credit Reporting Act. FirstCall Permits is not a consumer reporting agency;
• use Leads to harass, stalk or intimidate anyone, or for any unlawful or discriminatory purpose;
• scrape, bulk-download or copy the service beyond the export features we provide, or try to get around usage limits or access controls;
• reverse engineer the service or use it to build a competing product.

6. Contacting homeowners is your responsibility

You alone are responsible for how you contact anyone named in a Lead, and for following every law that applies, including the Telephone Consumer Protection Act, the Florida Telephone Solicitation Act, the National and Florida Do Not Call lists, the CAN-SPAM Act, the Florida Deceptive and Unfair Trade Practices Act, local solicitation and door-to-door ordinances, and any licensing rules for your trade. Leads contain property addresses, not phone numbers or email addresses. Don't represent yourself as being connected to the permit holder, the permit's contractor or any government agency. Honor every request to stop contacting someone.

7. Data accuracy

Leads come from public records and third-party data providers. Records can be incomplete, delayed, misclassified or wrong, and a permit doesn't guarantee that any homeowner needs or will buy your services. We don't guarantee any number of Leads, any particular coverage or any business results.

8. Your content

You keep ownership of what you add to the service, such as notes, quote amounts and pipeline status (“Your Content”). You give us permission to store and process it to provide the service, and to use it in aggregated, de-identified form to improve our matching (for example, which permit types lead to won jobs). We never share Your Content with other customers.

9. Our property

The service, its software, design, matching logic and compiled datasets belong to FirstCall Permits and our licensors. Apart from the limited license in section 5, these Terms don't grant you any rights in them. If you send us feedback or suggestions, we may use them without any obligation to you.

10. Suspension and termination

We may suspend or close your account if you breach these Terms, misuse Leads, fail to pay or create legal risk for us or others. We'll give notice where reasonable. You can stop using the service and cancel at any time. Sections 5–7 and 9–14 continue after termination.

11. Disclaimers

The service and Leads are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement, and we don't promise the service will be uninterrupted or error-free.

12. Limitation of liability

To the fullest extent allowed by law, FirstCall Permits won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, jobs or data. Our total liability for all claims relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

13. Indemnification

You'll defend and indemnify FirstCall Permits against any third-party claims, fines or costs, including reasonable attorneys' fees, arising from your use of Leads, your marketing or sales contact with anyone, or your breach of these Terms or the law.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Hillsborough County, Florida, and both parties consent to that jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. If a change is material, we'll notify you by email or in the app at least 14 days before it takes effect. If you continue to use the service after that, you've accepted the updated Terms.
